1 A BILL FOR AN ACT relating to political subdivisions; to prohibit
2 restrictions on the provision of certain energy services as
3 prescribed; and to provide an exception.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. (1) No county, city, village, or other political
2 subdivision of the state shall enact or implement any ordinance, code,
3 resolution, rule, regulation, or policy that restricts, prohibits, or has
4 the effect of restricting or prohibiting the types or fuel sources of
5 energy which may be used, delivered, converted, or supplied by the
6 following entities to serve customers that such entities are authorized
7 to serve:
8 (a) A natural gas utility;
9 (b) A natural gas transmission company; or
10 (c) A retail marketer or dispenser of propane.
11 (2) This section does not apply to ordinances, codes, resolutions,
12 rules, regulations, or policies:
13 (a) Governing a natural gas utility owned or operated and directly
14 controlled by a city or village; or
15 (b) Regulating a retail marketer or dispenser of propane.
