1 A BILL FOR AN ACT relating to insurance; to require an off-campus
2 location of a hospital to obtain and use a separate National
3 Provider Identifier in billing for health care services as
4 prescribed; and to define terms.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. (1) For purposes of this section:
2 (a) National Provider Identifier means the standard, unique health
3 identifier number for health care providers that is issued by the
4 national provider system in accordance with 45 C.F.R. Part 162, as such
5 regulations existed on January 1, 2023;
6 (b) Off-campus location means a facility:
7 (i) With operations that are directly or indirectly owned or
8 controlled by, in whole or in part, a hospital, or that is affiliated
9 with a hospital, regardless of whether such off-campus location is
10 operated by the same governing body as the hospital;
11 (ii) That is located more than two hundred fifty yards from the main
12 campus of the hospital;
13 (iii) That provides services which are organizationally and
14 functionally integrated with the hospital; and
15 (iv) That is an outpatient facility providing ambulatory surgery,
16 urgent care, or emergency room services.
17 (2) An off-campus location of a hospital shall obtain and use on all
18 claims for reimbursement or payment for health care services provided at
19 such location, a National Provider Identifier that is distinct from the
20 National Provider Identifier used by the main campus of the affiliated
21 hospital and any other off-campus locations of such hospital.
