1 A BILL FOR AN ACT relating to the Transportation Innovation Act; to amend
2 section 39-2806, Revised Statutes Cumulative Supplement, 2022; to
3 change provisions of the Economic Opportunity Program relating to
4 the limit on program expenditures and program purposes; to eliminate
5 an obsolete provision; and to repeal the original section.

1 Section 1. Section 39-2806, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 39-2806 The Economic Opportunity Program is created. The Department
4 of Transportation shall administer the program in consultation with the
5 Department of Economic Development using funds from the Transportation
6 Infrastructure Bank Fund, except that no more than forty twenty million
7 dollars shall be expended for this program. The purpose of the program is
8 to finance transportation improvements to attract and support new
9 businesses and business expansions, including, but not limited to,
10 livestock production and processing operations, by successfully
11 connecting such businesses to Nebraska’s multimodal transportation
12 network and to increase employment, create high-quality jobs, increase
13 business investment, and revitalize rural and other distressed areas of
14 the state. The Department of Transportation shall develop the program,
15 including the application process, criteria for providing funding,
16 matching requirements, and provisions for recapturing funds awarded for
17 projects with unmet obligations, in consultation with statewide
18 associations representing municipal and county officials, economic
19 developers, and the Department of Economic Development. No project shall
20 be approved through the Economic Opportunity Program without an economic
21 impact analysis proving positive economic impact. The details of the
22 program shall be presented to the Appropriations Committee and the
23 Transportation and Telecommunications Committee of the Legislature on or
24 before December 1, 2016.
25 Sec. 2. Original section 39-2806, Revised Statutes Cumulative
26 Supplement, 2022, is repealed.
