1 A BILL FOR AN ACT relating to energy assistance; to adopt the Capacity
2 Grant Act; and to declare an emergency.
3 Be it enacted by the people of the State of Nebraska,

1 Section 1. Sections 1 to 4 of this act shall be known and may be
2 cited as the Capacity Grant Act.
3 Sec. 2. For purposes of the Capacity Grant Act:
4 (1) Department means the Department of Environment and Energy; and
5 (2) Eligible nonprofit organization means a nonprofit organization
6 holding a certificate of exemption under section 501(c)(3) of the
7 Internal Revenue Code that administers weatherization programs through
8 the low-income home energy assistance program, as administered by the
9 State of Nebraska pursuant to the federal Energy Policy Act of 2005, 42
10 U.S.C. 8621 to 8630.
11 Sec. 3. (1) Any eligible nonprofit organization may apply to the
12 department on a form prescribed by the department for a capacity grant.
13 (2) The department may award up to two hundred fifty thousand
14 dollars in capacity grants to eligible nonprofit organizations in each
15 congressional district each year beginning in 2023 through 2026.
16 (3) It is the intent of the Legislature that the money needed for
17 such grants be appropriated from the General Fund.
18 Sec. 4. The department may adopt and promulgate rules and
19 regulations to carry out the Capacity Grant Act.
20 Sec. 5. Since an emergency exists, this act takes effect when
21 passed and approved according to law.
