1 A BILL FOR AN ACT relating to the Legislative Mental Health Care Capacity
2 Strategic Planning Committee; to amend section 50-702, Revised
3 Statutes Cumulative Supplement, 2022; to change contracting and
4 reporting requirements; to change a termination date; and to repeal
5 the original section.

1 Section 1. Section 50-702, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 50-702 (1) The Legislative Mental Health Care Capacity Strategic
4 Planning Committee is established. The committee shall consist of the
5 following members: (a) The chairperson of the Judiciary Committee of the
6 Legislature or his or her designee, (b) the chairperson of the Health and
7 Human Services Committee of the Legislature or his or her designee, (c)
8 the chairperson of the Appropriations Committee of the Legislature or his
9 or her designee, and (d) four senators selected by the chairperson of the
10 Executive Board of the Legislative Council. The committee shall select a
11 chairperson and vice-chairperson from among its members.
12 (2)(a) No later than November 1, 2023 2022, the Legislative Mental
13 Health Care Capacity Strategic Planning Committee shall contract with an
14 independent consultant with expertise in inpatient mental health care
15 delivery. The consultant shall assist the committee in determining the
16 necessary capacity for inpatient mental health care beds for both state-
17 operated and privately owned facilities based on best practices in mental
18 health care. The consultant shall provide recommendations to achieve the
19 necessary capacity if the current state inpatient mental health bed
20 capacity is insufficient.
21 (b) On or before November 1, 2024 2023, the consultant shall provide
22 a written report of its findings and recommendations to the Legislative
23 Mental Health Care Capacity Strategic Planning Committee.
24 (3) This section terminates on November 1, 2025 2024.
25 Sec. 2. Original section 50-702, Revised Statutes Cumulative
26 Supplement, 2022, is repealed.
