1 A BILL FOR AN ACT relating to the Nebraska State Capitol Preservation and
2 Restoration Act; to amend section 72-2211, Reissue Revised Statutes
3 of Nebraska, and section 72-2201, Revised Statutes Cumulative
4 Supplement, 2022; to change provisions relating to the Capitol
5 Restoration Cash Fund; to create the Capitol Preservation,
6 Restoration, and Enhancement Endowment Fund; to eliminate obsolete
7 provisions; to harmonize provisions; to repeal the original
8 sections; and to outright repeal section 72-2208, Reissue Revised
9 Statutes of Nebraska.
10 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 72-2201, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 72-2201 Sections 72-2201 to 72-2215 and section 3 of this act shall
4 be known and may be cited as the Nebraska State Capitol Preservation and
5 Restoration Act.
6 Sec. 2. Section 72-2211, Reissue Revised Statutes of Nebraska, is
7 amended to read:
8 72-2211 (1) The Capitol Restoration Cash Fund is created. The
9 administrator shall administer the fund, which shall consist of money
10 received from the sale of material, rental revenue, private donations,
11 public donations, transfers from the Capitol Preservation, Restoration,
12 and Enhancement Endowment Fund, and transfers from the Nebraska Capital
13 Construction Fund as directed by the Legislature.
14 (2)(a) The Capitol Restoration Cash Fund shall be used to finance
15 projects for the restoration, preservation, and enhancement of to restore
16 the State Capitol and its courtyards and capitol grounds to their
17 original condition, to purchase and conserve items to be added to the
18 Nebraska Capitol Collections housed in the State Capitol, to produce
19 promotional material concerning the State Capitol, its grounds, and the
20 Nebraska State Capitol Environs District, and to pay the expenditures for
21 a project manager for the Capitol Heating, Ventilation, and Air
22 Conditioning Systems Replacement Project until such time as the project
23 is completed, except that transfers may be made from the fund to the
24 General Fund at the direction of the Legislature. Such expenditures shall
25 be prescribed by the administrator and approved by the commission.
26 (b) Money transferred to the fund from the Capitol Preservation,
27 Restoration, and Enhancement Fund shall only be used for the restoration,
28 preservation, and enhancement of the courtyards located at the State
29 Capitol.
30 (3) Any money in the Capitol Restoration Cash Fund available for
31 investment shall be invested by the state investment officer pursuant to

1 the Nebraska Capital Expansion Act and the Nebraska State Funds
2 Investment Act.
3 Sec. 3. (1) The Capitol Preservation, Restoration, and Enhancement
4 Endowment Fund is created. The commission shall administer the fund. The
5 fund shall consist of money transferred to the fund by the Legislature
6 and bequests, donations, gifts, grants, or other money received from any
7 federal or state agency or public or private source for the preservation,
8 restoration, and enhancement of the State Capitol and capitol grounds.
9 Any money accepted by the state for credit to the fund that is subject to
10 conditions shall be held in trust and used subject to such conditions.
11 Any money in the fund available for investment shall be invested by the
12 state investment officer pursuant to the Nebraska Capital Expansion Act
13 and the Nebraska State Funds Investment Act.
14 (2) The State Treasurer shall transfer money from the Capitol
15 Preservation, Restoration, and Enhancement Endowment Fund to the Capitol
16 Restoration Cash Fund in amounts and at times as directed by the
17 commission. Money transferred from the Capitol Preservation, Restoration,
18 and Enhancement Fund in any year shall not exceed four percent of the
19 total balance in the fund as the balance existed on January 1 of the most
20 recent odd-numbered year.
21 Sec. 4. Original section 72-2211, Reissue Revised Statutes of
22 Nebraska, and section 72-2201, Revised Statutes Cumulative Supplement,
23 2022, are repealed.
24 Sec. 5. The following section is outright repealed: Section
25 72-2208, Reissue Revised Statutes of Nebraska.
