1 A BILL FOR AN ACT relating to the Tobacco Prevention and Control Program;
2 to amend section 71-5714, Reissue Revised Statutes of Nebraska; to
3 state legislative intent to appropriate money; and to repeal the
4 original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 71-5714, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 71-5714 (1) The Tobacco Prevention and Control Program is created
4 as a comprehensive statewide tobacco-related public health program
5 administered by the Department of Health and Human Services. The program
6 includes, but is not limited to (a) (1) community programs to reduce
7 tobacco use, (b) (2) chronic disease programs, (c) (3) school programs,
8 (d) (4) statewide programs, (e) (5) enforcement, (f) (6) counter
9 marketing, (g) (7) cessation programs, (h) (8) surveillance and
10 evaluation, and (i) (9) administration.
11 (2) It is the intent of the Legislature to appropriate one million
12 eighty-two thousand one hundred forty-six dollars and twenty-three cents
13 to the Department of Health and Human Services for each of fiscal years
14 2023-24 and 2024-25 from the Nebraska Health Care Cash Fund for Program
15 No. 30 for the Tobacco Prevention and Control Program.
16 The State Treasurer shall transfer, on July 1, 2016, the unobligated
17 balance in the Tobacco Prevention and Control Cash Fund to the Nebraska
18 Health Care Cash Fund.
19 Sec. 2. Original section 71-5714, Reissue Revised Statutes of
20 Nebraska, is repealed.
