1 A BILL FOR AN ACT relating to the Health Care Facility Licensure Act; to
2 amend section 71-401, Revised Statutes Cumulative Supplement, 2022;
3 to require the Department of Health and Human Services to pay
4 discharge incentives to post-acute placement facilities as
5 prescribed; and to repeal the original section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 71-401, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 71-401 Sections 71-401 to 71-479 and section 2 of this act shall be
4 known and may be cited as the Health Care Facility Licensure Act.
5 Sec. 2. When a hospital has reached a capacity equal to or greater
6 than ninety percent, the hospital shall notify the department. Upon
7 receiving such notice, the department shall pay discharge incentives to a
8 post-acute placement facility that accepts a referral for a patient with
9 complex health needs upon discharge from such hospital. Incentives shall
10 be paid in the following amounts:
11 (1) Six thousand dollars for a patient with medicaid as the primary
12 source of reimbursement;
13 (2) Three thousand dollars for a patient with a referral that was
14 made less than sixty days from the date of capacity notification to the
15 department; and
16 (3) Six thousand dollars for a patient with a referral that was made
17 sixty days or more from the date of capacity notification to the
18 department.
19 Sec. 3. This act becomes operative on September 10, 2023.
20 Sec. 4. Original section 71-401, Revised Statutes Cumulative
21 Supplement, 2022, is repealed.
