1 A BILL FOR AN ACT relating to health and human services; to state intent
2 regarding an increase in rates for child welfare aid; and to declare
3 an emergency.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. It is the intent of the Legislature that the Department
2 of Health and Human Services and the Supreme Court be appropriated funds
3 equivalent to implement a ten-percent increase for fiscal year 2023-24
4 and a seven-percent increase for fiscal year 2024-25 to reimbursement
5 rates for all child welfare service providers under Agency 25, Department
6 of Health and Human Services, Program 354, Child Welfare Aid, and Agency
7 5, Supreme Court, Program 437, Juvenile Justice. This increase is
8 intended to be in addition to any other increase provided by law. The
9 child welfare and juvenile justice service providers receiving the
10 increase, for those services currently used by Agency 25 and Agency 5,
11 include providers of Group Home Services, Out-of-Home Care Services, Out-
12 of-Home Maintenance, Agency-Supported Foster Care, Emergency Shelter
13 Center Care, Agency-Supported Respite Care, Drug Testing, In-Home Family
14 Support, Out-of-Home Family Support, Supervised Visitation, In-Home
15 Safety, Family Finding, Options Education, Kinship Navigation, Home
16 Studies, Travel Time and Distance, Intensive Family Preservation,
17 Intensive Family Reunification Service, and any other service presently
18 contracted for by the department with one or more private providers that
19 is intended to meet the needs of children and families in Nebraska.
20 Sec. 2. Since an emergency exists, this act takes effect when
21 passed and approved according to law.
