1 A BILL FOR AN ACT relating to the Health Care Facility Licensure Act; to
2 amend section 71-433, Reissue Revised Statutes of Nebraska; to
3 change provisions relating to an application for licensure to
4 operate a health care facility or a health care service; and to
5 repeal the original section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 71-433, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 71-433 (1) An applicant for an initial or renewal license to operate
4 a health care facility or health care service required to be licensed
5 under the Health Care Facility Licensure Act shall file a written
6 application with the department. The application shall be accompanied by
7 the license fee set pursuant to section 71-434 and shall set forth the
8 full name and address of the facility or service to be licensed, the full
9 name and address of the owner of such facility or service, the names of
10 all persons in control of the facility or service, and additional
11 information as required by the department, including affirmative evidence
12 of the applicant's ability to comply with rules and regulations adopted
13 and promulgated under the act. The application shall include the
14 applicant's social security number if the applicant is an individual. The
15 social security number shall not be public record and may only be used
16 for administrative purposes.
17 (2) The application shall be signed by (a) the owner, if the
18 applicant is an individual or partnership, (b) a member two of its
19 members, if the applicant is a limited liability company, (c) two of its
20 officers, if the applicant is a corporation, or (d) the head of the
21 governmental unit having jurisdiction over the facility or service to be
22 licensed, if the applicant is a governmental unit.
23 Sec. 2. Original section 71-433, Reissue Revised Statutes of
24 Nebraska, is repealed.
