1 A BILL FOR AN ACT relating to transportation network companies; to amend
2 section 75-333, Reissue Revised Statutes of Nebraska; to change a
3 requirement relating to uninsured and underinsured motorist
4 coverage; and to repeal the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 75-333, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 75-333 (1) Beginning on September 1, 2015, a transportation network
4 company and a participating driver shall maintain transportation network
5 company insurance as provided in this section. Unless otherwise
6 specified, the following requirements shall apply to transportation
7 network company insurance during the engaged stage and during the
8 passengers on board stage:
9 (a) Primary liability coverage in the amount of at least one million
10 dollars for death, personal injury, and property damage; and
11 (b) Uninsured and underinsured motorist coverage for both the driver
12 and passengers in the amount of at least one million dollars for bodily
13 injury, sickness, disease, or death amounts required by the Uninsured and
14 Underinsured Motorist Insurance Coverage Act.
15 (2) The requirements for the coverage required by this section may
16 be satisfied by any of the following:
17 (a) Transportation network company insurance maintained by a
18 participating driver;
19 (b) Transportation network company insurance maintained by a
20 transportation network company; or
21 (c) Any combination of subdivisions (2)(a) and (b) of this section.
22 (3) The insurer providing transportation network company insurance
23 under this section shall have the duty to defend and indemnify the
24 insured.
25 (4) An insurance policy required under sections 75-332 to 75-341
26 shall be placed with an authorized Nebraska insurer or with a surplus-
27 lines insurer pursuant to Chapter 44.
28 Sec. 2. Original section 75-333, Reissue Revised Statutes of
29 Nebraska, is repealed.
