1 A BILL FOR AN ACT relating to the Jobs and Economic Development
2 Initiative Act; to amend section 61-404, Revised Statutes Cumulative
3 Supplement, 2022; to prohibit the use of eminent domain as
4 prescribed; to harmonize provisions; and to repeal the original
5 section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 61-404, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 61-404 Notwithstanding any other provision of law, no land within
4 the Lake Development District, as designated by the Department of Natural
5 Resources pursuant to section 61-403, shall be (1) annexed by any
6 political subdivision of the state or (2) acquired by the state or any
7 political subdivision of the state through the use of eminent domain.
8 Sec. 2. Original section 61-404, Revised Statutes Cumulative
9 Supplement, 2022, is repealed.
