1 A BILL FOR AN ACT relating to developmental disabilities; to adopt the
2 Persons with Intellectual and Developmental Disabilities Assistance
3 Act; and to declare an emergency.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. Sections 1 to 4 of this act shall be known and may be
2 cited as the Persons with Intellectual and Developmental Disabilities
3 Assistance Act.
4 Sec. 2. For purposes of the Persons with Intellectual and
5 Developmental Disabilities Assistance Act:
6 (1) Department means the Department of Health and Human Services;
7 and
8 (2) Eligible nonprofit organization means a nonprofit organization
9 holding a certificate of exemption under section 501(c)(3) of the
10 Internal Revenue Code of 1986 that provides services to persons with
11 intellectual or developmental disabilities.
12 Sec. 3. (1) Any eligible nonprofit organization may apply to the
13 department on a form prescribed by the department for a grant under the
14 Persons with Intellectual and Developmental Disabilities Assistance Act.
15 (2) The department may award up to five hundred thousand dollars in
16 grants each fiscal year.
17 (3) It is the intent of the Legislature that the money needed for
18 such grants be appropriated from the General Fund.
19 Sec. 4. The department may adopt and promulgate rules and
20 regulations to carry out the Persons with Intellectual and Developmental
21 Disabilities Assistance Act.
22 Sec. 5. Since an emergency exists, this act takes effect when
23 passed and approved according to law.
