1 A BILL FOR AN ACT relating to public assistance; to adopt the Emergency
2 Food Assistance Act; and to declare an emergency.
3 Be it enacted by the people of the State of Nebraska,

1 Section 1. Sections 1 to 4 of this act shall be known and may be
2 cited as the Emergency Food Assistance Act.
3 Sec. 2. For purposes of the Emergency Food Assistance Act:
4 (1) Department means the Department of Health and Human Services;
5 and
6 (2) Eligible nonprofit organization means a nonprofit organization
7 holding a certificate of exemption under section 501(c)(3) of the
8 Internal Revenue Code that distributes food in ten or more counties in
9 Nebraska and qualifies for the Emergency Food Assistance Program
10 administered by the United States Department of Agriculture.
11 Sec. 3. (1) Any eligible nonprofit organization may apply to the
12 department on a form prescribed by the department for a grant under the
13 Emergency Food Assistance Act.
14 (2) The department may award up to ten million dollars in grants
15 each fiscal year.
16 (3) Any grant awarded under the Emergency Food Assistance Act shall
17 only be used for the following purposes:
18 (a) Purchase and distribute food;
19 (b) Infrastructure;
20 (c) Food storage;
21 (d) Equipment; and
22 (e) Construction of increased capacity.
23 (4) It is the intent of the Legislature that the money needed for
24 such grants be appropriated from the General Fund.
25 Sec. 4. The department may adopt and promulgate rules and
26 regulations to carry out the Emergency Food Assistance Act.
27 Sec. 5. Since an emergency exists, this act takes effect when
28 passed and approved according to law.
