1 A BILL FOR AN ACT relating to courts; to amend section 24-1302, Reissue
2 Revised Statutes of Nebraska; to provide duties for judges relating
3 to problem solving courts; to provide for allocation of duties by
4 the Supreme Court; and to repeal the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 24-1302, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 24-1302 (1) Drug, veterans, mental health, driving under the
4 influence, reentry, and other problem solving courts shall be subject to
5 rules which shall be promulgated by the Supreme Court for procedures to
6 be implemented in the administration of such courts.
7 (2) It is the intent of the Legislature that funds be appropriated
8 separately to the Supreme Court for each of the problem solving courts to
9 carry out this section and section 24-1301.
10 (3) It shall be the duty of each judge of the district court, in his
11 or her respective district; each judge of the county court, in his or her
12 respective county or counties; and each judge of a separate juvenile
13 court, in his or her respective county, to perform the duties of the
14 judges of the respective drug, veterans, mental health, driving under the
15 influence, reentry, and other problem solving courts established within
16 the district or counties served by the respective judges. Such duties
17 shall be equitably allocated among the judges of the respective courts.
18 If the judges of a particular district or county fail to equitably
19 allocate such duties among themselves by agreement, the Supreme Court
20 shall make such equitable allocations.
21 Sec. 2. Original section 24-1302, Reissue Revised Statutes of
22 Nebraska, is repealed.
