1 A BILL FOR AN ACT relating to elections; to amend section 32-101, Revised
2 Statutes Cumulative Supplement, 2022; to provide duties for the
3 Secretary of State regarding an audit of certain offices to
4 determine compliance with the federal Americans with Disabilities
5 Act; to harmonize provisions; and to repeal the original section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 32-101, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 32-101 Sections 32-101 to 32-1551 and section 2 of this act shall be
4 known and may be cited as the Election Act.
5 Sec. 2. Beginning in 2025 and every five years thereafter, the
6 Secretary of State shall conduct an audit of all the offices of the
7 Department of Motor Vehicles, the election commissioners, and the county
8 clerks, and of all of the polling locations throughout the State of
9 Nebraska, in order to determine compliance with the federal Americans
10 with Disabilities Act regarding facility and technology accessibility
11 issues. At the conclusion of each audit, the Secretary of State shall
12 report his or her findings along with any recommendations to the
13 Government, Military and Veterans Affairs Committee of the Legislature
14 and to the Governor. The report to the Legislature shall be made
15 electronically.
16 Sec. 3. Original section 32-101, Revised Statutes Cumulative
17 Supplement, 2022, is repealed.
