1 A BILL FOR AN ACT relating to the Funeral Directing and Embalming
2 Practice Act; to amend section 38-1416, Revised Statutes Cumulative
3 Supplement, 2022; to change a provision relating to apprenticeships;
4 and to repeal the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 38-1416, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 38-1416 (1) Before beginning an apprenticeship, an applicant shall
4 apply for an apprentice license. The applicant shall show that he or she
5 has completed twenty of the forty hours required in subdivision (1)(a) of
6 section 38-1414. The applicant may complete the twelve-month
7 apprenticeship in either a split apprenticeship or a full apprenticeship
8 as provided in this section.
9 (2) A split apprenticeship shall be completed in the following
10 manner:
11 (a) Application for an apprentice license to complete a six-month
12 apprenticeship prior to or while attending an accredited school of
13 mortuary science, which license shall be valid for six months from the
14 date of issuance and shall not be extended by the board. The
15 apprenticeship shall be completed over a continuous six-month period;
16 (b) Successful completion of a full course of study in an accredited
17 school of mortuary science;
18 (c) Successful passage of the national standardized examination; and
19 (d) Application for an apprentice license to complete the final six-
20 month apprenticeship, which license shall be valid for six months from
21 the date of issuance and shall not be extended by the board. The
22 apprenticeship shall be completed over a continuous six-month period.
23 (3) A full apprenticeship shall be completed in the following
24 manner:
25 (a) Successful completion of a full course of study in an accredited
26 school of mortuary science;
27 (b) Successful passage of the national standardized examination; and
28 (c) Application for an apprentice license to complete a twelve-month
29 apprenticeship. This license shall be valid for twelve months from the
30 date of issuance and shall not be extended by the board. The
31 apprenticeship shall be completed over a continuous twelve-month period.

1 (4) An individual registered as an apprentice on December 1, 2008,
2 shall be deemed to be licensed as an apprentice for the term of the
3 apprenticeship on such date.
4 Sec. 2. Original section 38-1416, Revised Statutes Cumulative
5 Supplement, 2022, is repealed.
