1 A BILL FOR AN ACT relating to the Nebraska Army National Guard; to state
2 legislative findings; and to require a command climate survey of the
3 guard and a report by the Adjutant General.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. The Legislature finds that:
2 (1) The state mission of the Nebraska Army National Guard is to
3 provide trained and equipped troops to protect life and property and to
4 preserve peace, order, and public safety;
5 (2) The federal mission of the Nebraska Army National Guard is to
6 provide the armed forces of the United States with trained and equipped
7 units in times of national emergency or war; and
8 (3) The readiness, morale, and command structure and leadership
9 climate of the Nebraska Army National Guard requires review to determine
10 whether any problems exist which may affect command and organizational
11 readiness, senior-leader performance, discipline, recruiting and
12 retention, and the process in which soldiers are promoted and assigned to
13 positions of greater responsibility.
14 Sec. 2. The Adjutant General shall cause to be conducted a top-down
15 command climate survey of the Nebraska Army National Guard to assess the
16 leadership climate, morale, and combat readiness of each echelon of
17 command in the organization, including separate companies and
18 detachments. The survey shall be conducted pursuant to applicable United
19 States Department of the Army and Army National Guard regulations. The
20 survey shall be performed by an external team of Army National Guard
21 officers and senior noncommissioned officers composed of personnel not
22 assigned to the Nebraska Army National Guard. Survey responses and
23 participation by individual soldiers shall be kept anonymous.
24 Sec. 3. The Adjutant General shall cause the command climate survey
25 team to be selected and begin the survey no later than ninety days after
26 the effective date of this act. The survey team leader shall be a
27 brigadier general. The survey team leader shall report to, but work
28 independently of, the Adjutant General. The Adjutant General shall
29 provide a report to the Governor and electronically to the Government,
30 Military and Veterans Affairs Committee of the Legislature on the
31 findings of the command climate survey. A new command climate survey

1 shall be conducted and a new report provided each time a successor
2 Adjutant General is appointed, such survey commencing no later than
3 ninety days after such appointment.
