1 A BILL FOR AN ACT relating to the Medical Assistance Act; to amend
2 section 68-901, Revised Statutes Cumulative Supplement, 2022; to
3 provide duties for the department regarding rates for critical
4 access hospitals; to harmonize provisions; and to repeal the
5 original section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 68-901, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 68-901 Sections 68-901 to 68-9,101 and section 2 of this act shall
4 be known and may be cited as the Medical Assistance Act.
5 Sec. 2. The department shall provide for rebasing inpatient interim
6 per diem rates for critical access hospitals. The department shall rebase
7 the rates on an annual basis, and the most recent audited medicare cost
8 report shall be used as the basis for the rebasing process within ninety
9 days after receiving the cost report.
10 Sec. 3. Original section 68-901, Revised Statutes Cumulative
11 Supplement, 2022, is repealed.
