1 A BILL FOR AN ACT relating to retirement; to amend section 68-621,
2 Reissue Revised Statutes of Nebraska; to redefine terms relating to
3 referendums on the state agreement extending certain federal
4 benefits to certain public employees in the state; and to repeal the
5 original section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 68-621, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 68-621 (1) A referendum group, as referred to in sections 68-621 to
4 68-630, shall consist of the employees of the state, a single political
5 subdivision of this state, or any instrumentality jointly created by this
6 state and any other state or states, the employees of which are or may be
7 members of a retirement system covering such employees, except that: (a)
8 The employees of the University of Nebraska shall constitute a referendum
9 group; (b) the employees of a Class V school district shall constitute a
10 referendum group; (c) all employees of the State of Nebraska who are or
11 may be members of the School Employees Retirement System of the State of
12 Nebraska, including employees of institutions operated by the Board of
13 Trustees of the Nebraska State Colleges, employees of institutions
14 operated by the Department of Correctional Services and the Department of
15 Health and Human Services, and employees subordinate to the State Board
16 of Education, shall constitute a referendum group; and (d) all employees
17 of school districts of the State of Nebraska, county superintendents, and
18 county school administrators, who are or may be members of the School
19 Employees Retirement System of the State of Nebraska, shall constitute a
20 single referendum group.
21 (2) The managing authority of a political subdivision or educational
22 institution shall be the board, committee, or council having general
23 authority over a political subdivision, university, college, or school
24 district whose employees constitute or are included in a referendum
25 group; the managing authority of the state shall be the Governor; and
26 insofar as sections 68-601 to 68-631 may be applicable to county
27 superintendents and county school administrators, managing authority
28 shall mean the board of county commissioners or county supervisors of the
29 county in which the county superintendent was elected or with which the
30 county school administrator contracted.
31 (3) Eligible employees, as referred to in sections 68-621 to 68-630,

1 means shall mean those employees of the state or any political
2 subdivision of the state thereof who at or during the time of voting in a
3 referendum as herein provided in this section are in positions covered by
4 a retirement system, are members of such retirement system, and were in
5 such positions at the time of giving of the notice of such referendum, as
6 herein required in this section, except that no such employee shall be
7 considered an eligible employee if at the time of such voting such
8 employee is in a position to which the state agreement applies or if such
9 employee is in service in a police officer or firefighter position.
10 (4) State agreement, as referred to in sections 68-621 to 68-630,
11 means shall mean the agreement between the State of Nebraska and the
12 designated officer of the United States of America entered into pursuant
13 to section 68-603.
14 Sec. 2. Original section 68-621, Reissue Revised Statutes of
15 Nebraska, is repealed.
