1 A BILL FOR AN ACT relating to appropriations; to state intent regarding
2 appropriations for the medical assistance program; to require an
3 annual report; and to declare an emergency.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. It is the intent of the Legislature to appropriate the
2 amount of funds necessary to the Department of Health and Human Services,
3 Program 348, Medical Assistance, to provide for rebasing rates as
4 described in this section.
5 There is included in the appropriation to this program for FY2023-24
6 $X,XXX,XXX General Funds and $X,XXX,XXX Federal Funds for rebasing
7 medicaid inpatient per diem rates for psychiatric facilities, hospital-
8 based psychiatric units, and psychiatric residential facilities. There is
9 included in the appropriation to this program for FY2024-25 $X,XXX,XXX
10 General Funds and $X,XXX,XXX Federal Funds for rebasing medicaid
11 inpatient per diem rates for psychiatric facilities, hospital-based
12 psychiatric units, and psychiatric residential facilities.
13 It is the intent of the Legislature to rebase the rates on an annual
14 basis and that the most recent audited medicare cost report be used as
15 the basis for the rebasing process. It is the intent of the Legislature
16 that the department provide an annual report electronically regarding
17 inpatient behavioral health bed capacity to the Clerk of the Legislature.
18 Sec. 2. It is the intent of the Legislature to appropriate the
19 amount of funds necessary to the Department of Health and Human Services,

26 appropriation to this program for FY2024-25 $X,XXX,XXX General Funds and
27 $X,XXX,XXX Federal Funds for rebasing medicaid inpatient per diem rates
28 for rehabilitative facilities and hospital-based rehabilitative units.
29 It is the intent of the Legislature to rebase the rates on an annual
30 basis and that the most recent audited medicare cost report be used as
31 the basis for the rebasing process. It is the intent of the Legislature

3 Sec. 3. Since an emergency exists, this act takes effect when
4 passed and approved according to law.
