1 A BILL FOR AN ACT relating to juveniles; to prohibit use of deception in
2 questioning juveniles; to prohibit admission of certain evidence;
3 and to define terms.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. (1) A peace officer interviewing, questioning, or
2 interrogating a juvenile in connection with an investigation of an act
3 that, if committed by an adult, would constitute a crime, shall not use
4 deception.
5 (2) A statement made by a juvenile as a result of a violation of
6 this section shall not be admissible as evidence against the juvenile in
7 any criminal or juvenile court proceeding.
8 (3) For purposes of this section:
9 (a) Deception means intentionally and knowingly:
10 (i) Communicating false facts about the evidence in a case; or
11 (ii) Representing or communicating false facts, false information,
12 or false statements to a juvenile regarding leniency in arrest,
13 prosecution, or disposition for such juvenile if the juvenile makes
14 certain statements or admissions during an interview, a questioning, or
15 an interrogation;
16 (b) Juvenile means any person under eighteen years of age; and
17 (c) Statement means any verbal, written, or sign-language
18 communication.
