1 A BILL FOR AN ACT relating to offenses; to amend section 28-348, Reissue
2 Revised Statutes of Nebraska, and section 28-101, Revised Statutes
3 Cumulative Supplement, 2022; to prohibit using an electronic
4 communication device or social media to engage in certain conduct
5 with vulnerable adults; to define a term; to harmonize provisions;
6 and to repeal the original sections.
7 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 28-101, Revised Statutes Cumulative Supplement,
2 2022, is amended to read:
3 28-101 Sections 28-101 to 28-1357, 28-1601 to 28-1603, and 28-1701
4 and section 3 of this act shall be known and may be cited as the Nebraska
5 Criminal Code.
6 Sec. 2. Section 28-348, Reissue Revised Statutes of Nebraska, is
7 amended to read:
8 28-348 Sections 28-348 to 28-387 and section 3 of this act shall be
9 known and may be cited as the Adult Protective Services Act.
10 Sec. 3. (1) A person commits the offense of digital grooming of a
11 vulnerable adult if he or she is nineteen years of age or older and
12 knowingly and intentionally uses an electronic communication device or
13 social media to communicate with a vulnerable adult with the intent to
14 commit any misdemeanor or felony against the vulnerable adult.
15 (2) A violation of this section is a Class IIIA felony.
16 (3) A violation of this section is deemed to have been committed
17 either at the place where the communication was initiated or where it was
18 received.
19 (4) For purposes of this section, electronic communication device
20 has the same meaning as in section 28-833.
21 Sec. 4. Original section 28-348, Reissue Revised Statutes of
22 Nebraska, and section 28-101, Revised Statutes Cumulative Supplement,
23 2022, are repealed.
