PROPOSED CONSTITUTIONAL AMENDMENT

1 THE MEMBERS OF THE ONE HUNDRED EIGHTH LEGISLATURE OF NEBRASKA, FIRST
2 SESSION, RESOLVE THAT:
3 Section 1. At the general election in November 2024 the following
4 proposed amendment to the Constitution of Nebraska shall be submitted to
5 the electors of the State of Nebraska for approval or rejection:
6 To amend Article IV, section 1:
7 IV-1 (1) The executive officers of the state shall be the Governor,
8 Lieutenant Governor, Secretary of State, Auditor of Public Accounts,
9 State Treasurer, Attorney General, and the heads of such other executive
10 departments as set forth herein or as may be established by law. The
11 Legislature may provide for the placing of the above named officers as
12 heads over such departments of government as it may by law establish.
13 (2) The Governor, Lieutenant Governor, Attorney General, Secretary
14 of State, Auditor of Public Accounts, and State Treasurer shall be:
15 (a) Chosen chosen at the general election held in November 1974, and
16 in each alternate even-numbered year thereafter, for a term of four years
17 and until their successors shall be elected and qualified; and .
18 (b) Nominated and elected in a nonpartisan manner and without any
19 indication on the ballot that they are affiliated with or endorsed by any
20 political party or organization.
21 (3) Each candidate for Governor shall select a person to be the
22 candidate for Lieutenant Governor on the general election ballot. In the
23 general election one vote shall be cast jointly for the candidates for

1 Governor and Lieutenant Governor. The Governor shall be ineligible to the
2 office of Governor for four years next after the expiration of two
3 consecutive terms for which he or she was elected.
4 (4) The records, books, and papers of all executive officers shall
5 be kept at the seat of government. Executive officers shall reside within
6 the State of Nebraska during their respective terms of office. Officers
7 in the executive department of the state shall perform such duties as may
8 be provided by law.
9 (5) The heads of all executive departments established by law, other
10 than those to be elected as provided herein, shall be appointed by the
11 Governor, with the consent of a majority of all members elected to the
12 Legislature, but officers so appointed may be removed by the Governor.
13 Subject to the provisions of this Constitution, the heads of the various
14 executive or civil departments shall have power to appoint and remove all
15 subordinate employees in their respective departments.
16 Sec. 2. The proposed amendment shall be submitted to the electors
17 in the manner prescribed by the Constitution of Nebraska, Article XVI,
18 section 1, with the following ballot language:
19 A constitutional amendment to provide for nonpartisan nomination and
20 election of the Governor, Lieutenant Governor, Attorney General,
21 Secretary of State, Auditor of Public Accounts, and State Treasurer.
