1 A BILL FOR AN ACT relating to the Medical Assistance Act; to amend
2 section 68-901, Revised Statutes Supplement, 2017, as amended by
3 section 1, Initiative Law 2018, No. 427, and section 2, Initiative
4 Law 2018, No. 427; to state intent; to create the Medicaid Expansion
5 Implementation Task Force; to provide powers and duties; to provide
6 a termination date; and to repeal the original section.

1 Section 1. Section 68-901, Revised Statutes Supplement, 2017, as
2 amended by section 1, Initiative Law 2018, No. 427, is amended to read:
3 68-901 Sections 68-901 to 68-991, and section 2 of this act, and
4 section 2 of this act shall be known and may be cited as the Medical
5 Assistance Act.
6 Sec. 2. (1) It is the intent of the Legislature to honor the will
7 of Nebraska voters and provide oversight of the implementation of
8 amendments to the Medical Assistance Act and the medicaid state plan to
9 expand eligibility to cover adults who are between nineteen and sixty-
10 four years of age and whose incomes are one hundred thirty-eight percent
11 of the federal poverty level and to maximize federal financial
12 participation to fund the care of such individuals. The Medicaid
13 Expansion Implementation Task Force is established to facilitate this
14 implementation process.
15 (2) The task force shall consist of six voting members: The
16 chairperson of the Health and Human Services Committee of the Legislature
17 or his or her designee, the chairperson of the Appropriations Committee
18 of the Legislature or his or her designee, the chairperson of the
19 Judiciary Committee of the Legislature or his or her designee, and three
20 members of the Legislature chosen by the Executive Board of the
21 Legislative Council.
22 (3) The task force shall also include seven nonvoting members chosen
23 by the Executive Board of the Legislative Council. Such members shall
24 include a health care provider licensed under the Uniform Credentialing
25 Act, a behavioral health care provider licensed under the Uniform
26 Credentialing Act, a health care consumer or consumer advocate, a
27 hospital representative, a business representative, a representative from
28 a political subdivision likely to have its constituency impacted by
29 medicaid expansion, and a rural health care provider.
30 (4) The task force shall hold at least three public hearings,
31 including one in each congressional district. Minutes of such meetings

1 shall be available to the public and provided to members of the
2 Legislature.
3 (5) To accomplish the objectives set forth in this section, the task
4 force may request, obtain, review, and analyze information relating to
5 public health issues in Nebraska and other states, including, but not
6 limited to, reports, audits, data, projections, and statistics.
7 (6) Members of the task force shall serve without compensation, but
8 they shall be entitled to reimbursement for their actual and necessary
9 expenses as provided in sections 81-1174 to 81-1177.
10 (7) The task force shall submit a report detailing its findings and
11 recommendations, if any, to the Legislature annually by December 1 of
12 each year, beginning December 1, 2019. Such report shall be submitted
13 electronically.
14 (8) The task force terminates on December 31, 2020, unless
15 reauthorized by the Legislature.
16 Sec. 3. Original section 68-901, Revised Statutes Supplement, 2017,
17 as amended by section 1, Initiative Law 2018, No. 427, and section 2,
18 Initiative Law 2018, No. 427, is repealed.
