The bill amends and reenacts section 49-02-26 of the North Dakota Century Code, which pertains to the qualifications for renewable electricity and recycled energy credits. The amendment removes the exception for certain hydroelectric facilities and clarifies that electricity must be generated from a source identified in section 49-02-25 to qualify for these credits. Specifically, the previous requirements regarding the in-service date of hydroelectric facilities and the conditions for new hydroelectric generation have been deleted.

Additionally, the bill repeals several sections (49-02-28 through 49-02-34) of the North Dakota Century Code that relate to state renewable and recycled energy objectives, public reporting, qualifications and applications for statewide objectives, the purchase and retirement of renewable energy certificates, verification of generation, and economic evaluations of renewable and recycled energy use. This repeal aims to streamline the regulatory framework surrounding renewable energy credits and objectives in North Dakota.
