This bill amends section 49-02-26 of the North Dakota Century Code, which pertains to the qualifications for renewable electricity and recycled energy credits. The amendment removes the exception for certain hydroelectric facilities and clarifies that electricity must be generated from a source identified in section 49-02-25. Specifically, it eliminates the requirement that hydroelectric facilities must have an in-service date of January 1, 2007, or later, or be new generation obtained from repowering or efficiency improvements to existing facilities as of August 1, 2007.
