This bill amends sections of the North Dakota Century Code to prohibit development projects by foreign adversaries, specifically targeting individuals or governments identified as such under the updated federal regulations. The amendments to sections 11-11-70 and 40-05-26 establish that county and city boards cannot approve development agreements with foreign adversaries, while also outlining exceptions for foreign adversaries that have been registered as businesses in good standing for at least seven years, have received approval from the Committee on Foreign Investment in the United States, and maintain a national security agreement with the federal government. The bill also clarifies the definition of "foreign adversary" in accordance with the new federal regulations.

Additionally, section 47-01-09 is amended to prohibit foreign adversaries and certain foreign business entities from acquiring real property in North Dakota after July 31, 2023, with specific conditions under which exceptions may apply. The bill mandates that any foreign government or business entity violating this prohibition must divest their real property within a specified timeframe, with penalties for non-compliance. Furthermore, the Department of Emergency Services is tasked with assessing vulnerabilities to foreign adversarial influence across various sectors and producing a report by July 1, 2026, which will include recommendations for mitigating risks and enhancing state security.
