This bill amends the North Dakota Century Code to clarify the definition of an "alcoholic beverage establishment" and to update regulations regarding gaming activities conducted by licensed organizations. The definition now specifies that an alcoholic beverage establishment is one where alcoholic beverages are sold and dispensed by employees for consumption on the premises, explicitly excluding liquor stores, gas stations, grocery stores, and convenience stores. Additionally, the bill outlines the conditions under which licensed organizations may conduct gaming, including stipulations about the separation of areas for different organizations and the age restrictions for patrons participating in various gaming activities.
Key changes include the insertion of language that allows electronic pull tabs, pull tabs, punchboards, twenty-one, paddlewheels, poker, and sports pools to be conducted only in designated areas within alcoholic beverage establishments where patrons must be at least twenty-one years old. The bill also establishes that organizations may not permit individuals under twenty-one to participate in certain gaming activities and sets limits on the number of electronic pull tab devices that can be installed at a site. Furthermore, organizations with more than fifteen licensed sites as of January 1, 2023, are restricted from increasing their number of sites, while those conducting gaming at authorized sites on that date may continue operations regardless of the establishment's classification.
