This bill proposes the creation of a new section in chapter 61-28.1 of the North Dakota Century Code that prohibits the addition of fluoride to public water supplies for the purpose of fluoridation. The bill defines "fluoride" and "public water supply," and explicitly states that no person may add any form of fluoride to public water systems, regardless of the concentration intended. However, the prohibition does not apply to naturally occurring fluoride in water sources or to fluoride used in industrial processes unrelated to public water treatment.

Violations of this new regulation will result in penalties, with a fine of $500 for the first offense and $1,000 for subsequent violations. The enforcement of this section will be the responsibility of the Department of Environmental Quality. The bill is set to take effect on August 1, 2026.
