This bill proposes the creation of a new section in chapter 50-24.1 of the North Dakota Century Code to establish paid family caregiver services under the Medicaid 1915(c) waiver program. The Department of Human Services is tasked with submitting amendments to current and future Medicaid waivers to allow for payments to legally responsible individuals who provide care to eligible individuals, excluding those under the aged and disabled waiver. The bill outlines that when a paid family caregiver service option is available, an assessment will be conducted to determine the level of care needed, taking into account various factors such as age, daily living activities, medical, and emotional needs.

Additionally, the bill stipulates that payments to caregivers must align with the current self-directed direct support professional hourly wage and are capped at 40 hours per week. The cross-disability advisory council is also mandated to participate in advising the department on the planning and administration of these services, including the development of the assessment method for determining care levels. This initiative aims to enhance support for family caregivers and ensure that the services provided are tailored to the unique needs of individuals receiving care.
