This bill proposes the establishment of a grant program aimed at supporting the education of nonbeneficiary students attending tribally controlled schools in North Dakota. A new section is added to chapter 15.1-01 of the North Dakota Century Code, defining "nonbeneficiary student" as those enrolled in a tribally controlled school who are neither enrolled members of a federally recognized Indian tribe nor biological children of a descendant member of an Indian tribe. The superintendent of public instruction is tasked with providing grants to these schools to help cover the costs associated with educating nonbeneficiary students.

Additionally, the bill amends section 54-40.2-02 of the North Dakota Century Code to clarify the process for public agencies and tribal governments to enter into agreements. Notably, it specifies that if a school district is involved in an agreement that allows for the enrollment of students from a tribal school receiving funding under the Tribally Controlled Schools Act, the school district must ensure that it retains its identity and decision-making authority while fulfilling its statutory duties. The amendments also include provisions for notifying the superintendent of public instruction and considering their recommendations regarding such agreements.
