This bill amends section 6-09.4-22 of the North Dakota Century Code to enhance the protection of water service agreements during the term of loans provided to political subdivisions. It specifies that water service, financed in whole or in part by loans from the public finance authority or other state agencies, cannot be curtailed or limited by the inclusion of the service area within another political subdivision's boundaries or by the granting of private franchises for similar services. Additionally, it clarifies that the political subdivision providing the service is not required to obtain any franchise, license, or permit to continue serving the area during the loan term. The bill also defines "water service" as service provided under chapter 61-28.1.

Furthermore, the bill removes previous requirements for agreements between political subdivisions regarding service provision, stating that only the public finance authority or state agency providing the financing may enforce the provisions of this section. It also establishes that this section does not create a cause of action or claim for political subdivisions. Importantly, the bill includes a retroactive application clause, making it effective from July 31, 1997.
