This bill proposes amendments to the North Dakota Century Code regarding adult residential facilities, specifically focusing on the definition of such facilities and the establishment of payment rates. The definition of "adult residential facility" is expanded to include licensed basic care facilities that cater to individuals with chronic memory loss or significant emotional, behavioral, or cognitive impairments, and that provide various therapeutic and daily living assistance services. Additionally, a new section is introduced that mandates adult residential facilities to submit cost reports and supplemental information by specified deadlines, which will be used to determine payment rates starting January 1, 2026, and recalculated on July 1, 2027.

Furthermore, the bill requires the Department of Health and Human Services to submit progress reports to the legislative management regarding the basic care study recommendations and the review of asset limits for home and community-based services. An appropriation of $1,709,302 is allocated from the general fund and other federal and special funds to support the administration of adult residential facility rates for the biennium from July 1, 2025, to June 30, 2027.
