The bill amends section 4.1-09-19 of the North Dakota Century Code, which pertains to the refunding of assessments collected by the oilseed council. It modifies the process for producers seeking refunds by removing the requirement for a written request for a refund application within sixty days of the assessment or final settlement. Instead, producers are now required to complete and return a refund application to the council within ninety days of the assessment or final settlement, along with a record of the assessment collected. The council is mandated to refund the net amount of the assessment within thirty days of receiving the refund application.
Additionally, the bill introduces a provision that the council must provide the refund application form through secured electronic means. It maintains the stipulation that if a request for a refund is not submitted within the specified time frame, the producer is presumed to have agreed to the assessment. Furthermore, a producer is only eligible for a refund if the refundable amount is five dollars or more.
