The bill amends section 4.1-09-19 of the North Dakota Century Code, which pertains to the refunding of assessments collected by the oilseed council. It modifies the process for producers seeking refunds by removing the requirement to submit a written request for a refund application within sixty days of the assessment or final settlement. Instead, producers are now required to complete and return the refund application along with a record of the assessment collected within ninety days of the assessment or final settlement. The council is mandated to refund the net amount of the assessment collected within thirty days of receiving the refund application.

Additionally, the bill introduces a provision that the council must provide the refund application form through secured electronic means. It maintains that if a request for a refund is not submitted within the specified time frame, the producer is presumed to have agreed to the assessment. Furthermore, it stipulates that a producer is only entitled to a refund if the refundable amount is five dollars or more.
