The bill amends section 40-29-03 of the North Dakota Century Code regarding the process for notifying property owners about the construction, rebuilding, or repair of sidewalks. It establishes that when the governing body determines such work is necessary, they must notify the property owner or occupant at their last known address. The notice will inform them that they are responsible for the sidewalk work at their own expense, subject to approval from the street commissioner or city engineer, and must be completed within a specified timeframe of no less than two years and six months from the date of the notice.

Additionally, the bill specifies that the notice must detail the required work and the timeline for completion, and it can be served via certified mail or by delivering a copy directly to the property owner or occupant. If the property is unoccupied and mail service is impractical, the notice may be posted in a conspicuous location. If the sidewalk is not repaired within the designated time, the street commissioner or city engineer is authorized to carry out the repairs and certify the costs to the city auditor, which will be funded from the sidewalk special fund.
