This bill amends section 49-04.1-01 of the North Dakota Century Code to include new definitions related to utility metering, specifically introducing the term "smart meter gateway device." This device is defined as an electronic device that produces an electronic signal and serves as a load control device ancillary to the electric utility meter at a user's residence or business. Additionally, the bill clarifies the definitions of "bypassing," "customer," "tampering," "unauthorized metering," "utility," "utility service," and "utility supply system," with some terms being renumbered as a result of these changes.

Furthermore, the bill establishes a new section that mandates consent for the installation of smart meter gateway devices. Utilities are required to provide a consent form to property owners, which must include information about the option to opt-out of the installation without service interruption. It also stipulates that upon the initial provision of services, utilities must disclose whether a smart meter gateway device has been installed and allow for its removal upon request, replacing it with a traditional electromechanical meter if desired.
