This bill amends the North Dakota Century Code to include new definitions and regulations regarding the installation of smart meter gateway devices by utility services. It introduces the term "smart meter gateway device," which refers to electronic devices that communicate with appliances using electricity, water, or gas in a user's residence or business. The bill also clarifies the definitions of "tampering" and "unauthorized metering," ensuring that unauthorized actions regarding utility meters are clearly defined.

Additionally, the bill establishes that utility services cannot install a smart meter gateway device without obtaining consent from the property owner through a prescribed form. This form must inform the owner of their right to opt-out of the installation without affecting their utility service. Furthermore, upon the initial provision of services, utilities are required to disclose whether a smart meter gateway device has been installed and must allow for its removal upon request, replacing it with a traditional electromechanical meter if desired.
