This bill proposes the creation of a new chapter in Title 14 of the North Dakota Century Code, which focuses on fertility health care treatment rights. It establishes definitions for key terms such as "assisted reproduction," "fertility treatment," and "health care provider," among others. The bill asserts that the state or any political subdivision cannot implement laws or policies that restrict access to assisted reproduction services or fertility treatments. It guarantees individuals the right to receive fertility treatment, make decisions regarding reproductive genetic material, and enter contracts with health care providers. Additionally, it affirms the rights of health care providers, health carriers, and manufacturers in relation to fertility treatment and reproductive genetic material.

The bill also outlines penalties for violations of these rights, allowing civil actions to be brought against state agencies or individuals who enact policies that restrict the rights established in this chapter. If a court finds a violation, it can declare the policy unlawful and provide equitable relief, including attorney's fees for the prevailing plaintiff. However, the enforcement of health and safety laws regarding medical facilities or providers is not considered a violation if it aligns with widely accepted medical standards and cannot be achieved through less restrictive means.
