This bill proposes the creation of a new section in the North Dakota Century Code that mandates minimum standards for health insurance coverage of antiobesity medications. Specifically, it requires that the prescription drug component of health insurance must cover at least two FDA-approved antiobesity medications for chronic weight management in patients with obesity. The bill stipulates that coverage criteria cannot be more restrictive than FDA-approved indications and may include cost-sharing requirements consistent with other pharmaceutical coverage. Additionally, insurers are required to notify policyholders about this coverage in a clear and accessible manner.

The bill also outlines that the public employees retirement system must prepare a report for the legislative assembly regarding the impact of this coverage on health insurance programs, including utilization and costs, and make recommendations on whether to continue the coverage. The provisions of this Act will apply to health benefits coverage starting after June 30, 2025, and will expire on June 30, 2027, unless a subsequent bill is introduced to repeal the expiration date and extend the coverage to all health insurance policies.
