The bill amends section 53-06.1-11.2 of the North Dakota Century Code, which pertains to the charitable gaming operating fund. It establishes that the fund will consist of all gaming taxes, monetary fines, and interest and penalties collected under the relevant chapter. The attorney general is tasked with allocating the remaining funds on a quarterly basis, with a new allocation of seventy-five thousand dollars to the gambling disorder prevention and treatment fund, replacing the previous allocation of ten thousand dollars. Additionally, five percent of the total moneys in the fund will be distributed to cities and counties based on the taxes collected from licensed organizations conducting games.

Furthermore, the bill modifies the process for transferring excess funds to the general fund. The attorney general is now required to transfer the balance of net proceeds in the charitable gaming operating fund that exceeds the appropriated amount for administrative and operating costs to the general fund before the end of each biennium, replacing the previous requirement for the state treasurer to certify and transfer accumulated funds by June 30 of each odd-numbered year. This change streamlines the process and ensures timely allocation of excess funds.
