The proposed amendments to the North Dakota Century Code aim to enhance the legal framework surrounding the possession of certain computer-generated images and materials depicting sexual conduct involving minors. The bill introduces new definitions, including "computer-generated image," which refers to images created through artificial intelligence or computer programs, and clarifies that a "minor" can also refer to a computer-generated image that appears to depict an individual under eighteen years of age. Additionally, the definitions of "obscene sexual performance," "performance," "promote," "sexual conduct," "sexual performance," and "simulated" have been updated to align with these new provisions.

Furthermore, the bill establishes penalties for the possession of such materials. A person found guilty of knowingly possessing any motion picture, computer-generated image, photograph, or other visual representation that includes sexual conduct by a minor will face a class C felony charge. More severe penalties, classified as a class B felony, are outlined for offenses involving twenty or more images, sadistic or masochistic conduct, sexual bestiality, or involving prepubescent minors. The bill also clarifies that liability does not extend to providers of interactive computer services for content provided by others, ensuring that internet service providers and similar entities are not held accountable for such materials.
