The proposed bill seeks to amend North Dakota law concerning sexually explicit deep fake videos and images, as well as to revise the registration requirements for sexual offenders. It introduces new legal definitions and penalties, categorizing the production, possession, and distribution of sexually explicit deep fake content as a class A misdemeanor. Victims depicted in these deep fakes are granted the right to pursue civil action against offenders for damages, including economic and noneconomic damages, statutory damages, and attorney's fees. The bill also redefines "sexually expressive image" to encompass various forms of visual representations and establishes penalties for creating or distributing such images without consent.

In addition to addressing deep fakes, the bill modifies existing legislation related to sexual offenders by removing outdated definitions and clarifying registration requirements. It eliminates the obligation for courts to forward registration forms to law enforcement prior to an offender's release and removes the requirement for courts to inform individuals of their duty to register. The bill establishes a minimum registration duration of fifteen years, with extensions based on risk assessments, and prohibits high-risk offenders from residing near schools. It also mandates public disclosure of registration information for moderate and high-risk offenders when necessary for public safety, aiming to enhance victim protection and streamline legal processes related to sexual offenses.
