This bill introduces a new section to chapter 54-52.1 of the North Dakota Century Code, establishing cost-sharing restrictions for diagnostic and supplemental breast examinations. It defines "diagnostic breast examination" and "supplemental breast examination," outlining the types of medically necessary procedures included under these terms. The bill mandates that health insurance coverage provided by the board cannot impose any deductibles, copayments, coinsurance, or other cost-sharing requirements that would lead to out-of-pocket costs for individuals undergoing these examinations. However, it includes a provision that allows for exceptions if applying these restrictions would jeopardize the eligibility of a health benefit plan as a qualified high-deductible health plan under federal law.

Additionally, the bill requires the public employees retirement system to prepare a report for the legislative assembly regarding the impact of these cost-sharing restrictions on health insurance programs, including utilization and costs. The Act is set to apply to health benefits coverage beginning after June 30, 2025, and will expire on June 30, 2027, unless extended by future legislation. The public employees retirement system is tasked with introducing a bill to repeal the expiration date and extend the cost-sharing restrictions to all health insurance policies, along with the necessary report on its effects.
