The bill amends subsection 9 of section 39-06.1-06 of the North Dakota Century Code, which pertains to violations of speed limits in highway construction zones. The amendment increases the fee for speeding in these zones from eighty-one dollars to
hundred fifty dollars for exceeding the speed limit by one to ten miles per hour. Additionally, for speeds exceeding ten miles per hour over the limit, the fee will be
hundred fifty dollars plus two dollars for each additional mile per hour over the limit, unless a greater fee applies.
Furthermore, the bill clarifies that the fee for speeding in a construction zone is only applicable when the posted speed limit sign indicates "Minimum Fee $150." It also removes the requirement that "individuals engaged in construction" must be present at the time and place of the violation for the fee to apply. This change aims to streamline enforcement and ensure that penalties are consistently applied in construction zones, regardless of the presence of construction workers.
