This bill amends sections 39-08-01.2 and 39-08-01.4 of the North Dakota Century Code to enhance penalties for individuals operating a vehicle under the influence of alcohol or drugs, particularly when such actions result in injury or death. The bill introduces new legal language specifying that causing injury or death while under the influence now includes "any other drugs or substances," and establishes that individuals guilty of criminal vehicular homicide will face a class A felony charge with a minimum of three years' imprisonment, escalating to ten years for repeat offenders. Additionally, it clarifies the definitions of criminal vehicular injury and the associated penalties.

Furthermore, the bill addresses driving under the influence while accompanied by a minor, categorizing it as a class A misdemeanor for first-time offenders, with increased penalties for repeat offenses. The minimum sentence for a first offense includes a fine, mandatory imprisonment, a substance abuse evaluation, and participation in a sobriety program. For subsequent offenses, the penalties are significantly heightened, including longer imprisonment and higher fines. The provisions of this bill will apply to criminal charges filed after its effective date.
