This bill amends the North Dakota Century Code regarding the moratorium on the addition of basic care and nursing facility bed capacity. Specifically, it establishes a moratorium period from August 1, 2023, to July 31, 2025, during which no new basic care beds may be added to the state's licensed bed capacity, with certain exceptions. These exceptions include the conversion of nursing facility beds to basic care, licensing of transferred bed capacity, and instances where an entity can demonstrate a lack of available basic care services in a designated area. Additionally, the Department may grant approval for new basic care beds, which must be licensed within 48 months of approval.
The bill also addresses nursing facility beds, stating that no new nursing facility beds may be added during the same moratorium period, except in cases where a facility reverts basic care beds back to nursing facility beds or relicenses previously deliced nursing facility beds. Furthermore, it restricts nursing facilities from reconfiguring their licensed bed capacity more than twice within a twelve-month period. These amendments aim to regulate the capacity of basic care and nursing facilities in North Dakota to ensure adequate service availability while managing resources effectively.
