1 A BILL for an Act to provide an appropriation for defraying the expenses of the agriculture
2 commissioner; and to provide for a transfer.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. APPROPRIATION. The funds provided in this section, or so much of the funds
5 as may be necessary, are appropriated out of any moneys in the general fund in the state
6 treasury, not otherwise appropriated, and from other funds derived from special funds and
7 federal funds, to the agriculture commissioner for the purpose of defraying the expenses of the
8 agriculture commissioner, for the biennium beginning July 1, 2025, and ending June 30, 2027,
9 as follows:

4 SECTION 2. OTHER FUNDS - TRANSFER - DEPARTMENT OF WATER RESOURCES.
5 The other funds line item in section 1 of this Act includes the sum of $125,000 which the
6 department of water resources shall transfer to the agriculture commissioner for the purpose of
7 defraying the expenses of the wildlife services program.
8 SECTION 3. TRANSFER - ENVIRONMENT AND RANGELAND PROTECTION FUND -
9 MINOR USE PESTICIDE FUND. The agriculture commissioner shall transfer $325,000 from the
10 environment and rangeland protection fund to the minor use pesticide fund during the biennium
11 beginning July 1, 2025, and ending June 30, 2027.
12 SECTION 4. OTHER FUNDS - ENVIRONMENT AND RANGELAND PROTECTION FUND.
13 The other funds line item in section 1 of this Act includes the sum of $7,415,020 from the
14 environment and rangeland protection fund for the purpose of defraying the expenses of various
15 agriculture commissioner programs.
16 SECTION 5. OTHER FUNDS - GAME AND FISH FUND. The other funds line item in
17 section 1 of this Act includes the sum of $648,228 from the game and fish department operating
18 fund for the purpose of defraying the expenses of various agriculture commissioner programs.
19 SECTION 6. OTHER FUNDS - ABANDONED OIL AND GAS WELL PLUGGING AND
20 SITE RECLAMATION FUND. The other funds line item in section 1 of this Act includes the sum
21 of $700,000 from the abandoned oil and gas well plugging and site reclamation fund, of which
22 $200,000 is for the purpose of defraying the expenses of the pipeline restoration and
23 reclamation program and $500,000 is for the purpose of defraying the expenses of the
24 post-production royalty oversight program.
25 SECTION 7. TRADE OFFICE - MATCHING FUND REQUIREMENT. The North Dakota
26 trade office line item and the general fund appropriation in section 1 of this Act include
27 $1,600,000 of funding related to the North Dakota trade office. The agriculture commissioner
28 may spend sixty percent of this amount without requiring any matching funds from the trade
29 office. Any additional amounts may be spent only to the extent the North Dakota trade office
30 provides one dollar of matching funds from private or other public sources for each one dollar
31 provided by the agriculture commissioner. Matching funds may include money spent by

1 businesses or organizations to pay salaries to export assistants, provide training to export
2 assistants, or purchase computer equipment as part of the North Dakota trade office's export
3 assistant program.
4 SECTION 8. WATERBANK PROGRAM - MATCHING FUNDS. The salaries and wages line
5 item in section 1 of this Act includes up to $50,000 from the general fund for matching funds for
6 the North Dakota outdoor heritage fund grant provided for the waterbank program.
