1 A concurrent resolution directing the Legislative Management to consider studying the feasibility
2 and desirability of consolidating the administration of racing, sports, and gaming activities into a
3 single office, whether as a division of the Attorney General's office or a separate agency, and
4 the feasibility and desirability of creating a sports and gaming commission to expand or replace
5 the North Dakota Racing Commission to include oversight of sports and gaming activities,
6 including mixed martial arts, boxing, and live combative sports; charitable gaming, including
7 licensing and permits; sports betting and other permitted games of chance; the lottery; live and
8 simulcast racing; and other similar activities.
9 WHEREAS, interest in sports and gaming and associated revenues is increasing
10 significantly in North Dakota; and
11 WHEREAS, North Dakotans spent nearly $1.3 billion on electronic pull tabs alone in fiscal
12 year 2021, nearly double the amount spent in fiscal year 2020, and are on pace to spend as
13 much in fiscal year 2022; and
14 WHEREAS, as many as 138,000 North Dakotans are reportedly betting a combined
15 $300 million annually on sports; and
16 WHEREAS, legalization of and a framework for the regulation of sports betting for the
17 betterment of North Dakota and North Dakota consumers may be forthcoming; and
18 WHEREAS, North Dakotans spent over $30 million on lottery tickets in fiscal year 2021;
19 and
20 WHEREAS, lottery ticket sales increased by 24.5 percent from fiscal year 2020 to fiscal
21 year 2021, representing an increase of $6 million in sales; and
22 WHEREAS, the creation of a sports and gaming commission and the consolidation and
23 centralization of sports and gaming administration may be beneficial as sports and gaming
24 interest and revenue continue to grow;

1 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF
2 NORTH DAKOTA, THE SENATE CONCURRING THEREIN:
3 That the Legislative Management consider studying the feasibility and desirability of
4 consolidating the administration of racing, sports, and gaming activities into a single office,
5 whether as a division of the Attorney General's office or a separate agency, and the feasibility
6 and desirability of creating a sports and gaming commission to expand or replace the North
7 Dakota Racing Commission to include oversight of sports and gaming activities, including mixed
8 martial arts, boxing, and live combative sports; charitable gaming, including licensing and
9 permits; sports betting and other permitted games of chance; the lottery; live and simulcast
10 racing; and other similar activities; and
11 BE IT FURTHER RESOLVED, that the Legislative Management report its findings and
12 recommendations, together with any legislation required to implement the recommendations, to
13 the Sixty-ninth Legislative Assembly.
