1 A BILL for an Act to amend and reenact section 48-01.2-02.1 of the North Dakota Century
2 Code, relating to the threshold for procuring plans, drawings, and specifications from an
3 architect or engineer for construction of a public improvement.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Section 48-01.2-02.1 of the North Dakota Century Code is
6 amended and reenacted as follows:
7 48-01.2-02.1. Public improvement construction threshold.
8 1. The threshold for bidding construction of a public improvement is two hundred
9 thousand dollars. The threshold for procuring plans, drawings, and specifications from
10 an architect or engineer for construction of a public improvement is two hundred
11 thousandone million dollars. A pre-engineered unit being constructed as a public
12 improvement is not subject to the requirements for procuring plans, drawings, and
13 specifications from an architect or engineer under this section.
14 2. Notwithstanding the thresholds in subsection 1, if the state or a political subdivision
15 undertakes the construction of a public improvement and there is reason to believe
16 that engineering or architectural services are necessary to protect the health, safety, or
17 welfare of the public, the state or political subdivision shall consider consulting with an
18 engineer or architect.
