1 A BILL for an Act to create and enact a new section to chapter 11-10, a new section to chapter
2 40-05, and a new section to chapter 58-03 of the North Dakota Century Code, relating to traffic
3 signs.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. A new section to chapter 11-10 of the North Dakota Century Code is created
6 and enacted as follows:
7 Addition of penalty to traffic signs - Requirements.
8 1. The department of transportation shall allow a county to affix to any traffic sign within
9 the county the amount of the penalty for violation of an offense corresponding with the
10 purpose of the sign.
11 2. A county may affix the amount of the penalty to a traffic sign under subsection 1 only if
12 the:
13 a. County has adopted an ordinance indicating a traffic offense;
14 b. Ordinance states the penalty for violation of the offense;
15 c. Ordinance is actively being enforced;
16 d. Department of transportation procures the sign for the county; and
17 e. County covers or reimburses the department of transportation all costs related to
18 the installation of the sign.
19 3. The penalty sign must be uniform in size and text in relation to the traffic sign to which
20 it is affixed.
21 4. This section applies to all township and county roads and state highways.
22 SECTION 2. A new section to chapter 40-05 of the North Dakota Century Code is created
23 and enacted as follows:
