1 A BILL for an Act to create and enact a new section to chapter 23-12 of the North Dakota
2 Century Code, relating to pregnancy counseling services.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. A new section to chapter 23-12 of the North Dakota Century Code is created
5 and enacted as follows:
6 Pregnancy counseling services.
7 1. An entity that receives state funds to provide pregnancy counseling services, as a
8 condition of receipt of the funds, shall meet minimum standards as provided under this
9 section.
10 2. Under this section, an entity:
11 a. Must have a qualified administrator who is:
12 (1) A licensed physician;
13 (2) A licensed registered or advanced practice registered nurse;
14 (3) A college graduate with a minimum of a bachelor's degree who has a
15 minimum of three years of health care management experience; or
16 (4) An individual who does not have a bachelor's degree but who has a
17 minimum of six years of health care management experience.
18 b. Must retain the services of at least one individual qualified to provide counseling
19 services who does not practice outside the professional scope of practice for that
20 individual.
21 c. Shall organize the services of the entity to ensure quality of patient care,
22 including maintenance of an organizational chart that includes:
23 (1) A description of each service offered;
24 (2) The policies and procedures pertaining to each service;

1 (3) A job description for each discipline; and
2 (4) A description of the system for maintenance of patient records.
